Қазақстан Республикасының Мәдениет және ақпарат министрі А. Балаева "уәкілетті органның жанынан медиаторлар ұйымдарымен өзара іс-қимыл жөніндегі үйлестіру кеңесін құру туралы" 2025 жылғы 15 сәуірдегі бұйрыққа қол қойды, деп хабарлайды Zakon.kz.

Сондай-ақ уәкілетті орган жанындағы медиаторлар ұйымдарымен өзара іс-қимыл жөніндегі үйлестіру кеңесі және үйлестіру кеңесінің құрамы туралы ереже бекітілді.

Медиаторлар ұйымдарымен өзара іс-қимыл жөніндегі үйлестіру кеңесі консультативтік-кеңесші орган болып табылады.

Үйлестіру кеңесі қызметінің мақсаты уәкілетті органның Қазақстандағы медиация институтын дамыту және жетілдіру үшін медиаторлар ұйымдарымен және өзге де мүдделі тараптармен тиімді өзара іс-қимылын қамтамасыз ету болып табылады.

Үйлестіру кеңесінің міндеттері:

медиация саласындағы заңнаманы жетілдіру бойынша ұсыныстар әзірлеу;
медиация саласындағы мемлекеттік саясатты қалыптастыруға және іске асыруға жәрдемдесу;
Медиация тәжірибесінде туындайтын проблемалық мәселелерді талдау және оларды шешу бойынша ұсыныстар әзірлеу;
медиация саласында өзін-өзі реттеуді дамыту және медиаторлардың кәсіби жауапкершілік институтын нығайту;
медиаторлар ұйымдары мен уәкілетті орган арасындағы ашық диалогты қамтамасыз ету;
оқытудың оқу бағдарламаларын мақұлдау және медиаторлардың біліктілігін арттыру.
медиаторлар ұйымдарының үлгілік жарғысын әзірлеу және бекіту.
Үйлестіру кеңесі мынадай функцияларды жүзеге асырады:

медиаторлардың кәсіби даярлығы мен біліктілігін арттыру мәселелерін талқылайды;
медиация институтын дамыту және оны одан әрі жетілдіру үшін қолайлы жағдайлар жасау жөнінде ұсыныстар әзірлейді және ұсынымдар әзірлейді;

Үйлестіру кеңесінің құрамына: Үйлестіру кеңесінің төрағасы, төрағаның орынбасары, хатшысы және мүшелері кіреді.

Құрамына уәкілетті органның, уәкілетті органның жанындағы медиаторлар ұйымдарының тізіліміне енгізілген кәсіби медиаторлар ұйымдарының өкілдері енгізіледі.

Медиаторлар ұйымдары өкілдерінің құрамы жылына кемінде бір рет өзектендіріледі.

Бұйрық қол қойылған күнінен бастап қолданысқа енгізіледі.

The Minister of Culture and Information of the Republic of Kazakhstan, A.Balayeva, signed an order dated April 15, 2025 "On the establishment of a Coordinating Council for cooperation with organizations of mediators under the authorized body," reports Zakon.kz .

The regulation on the Coordinating Council for Cooperation with Mediation Organizations under the authorized body and the composition of the Coordinating Council were also approved.

The Coordinating Council for Cooperation with Mediation Organizations is an advisory body.

The purpose of the Coordinating Council is to ensure effective interaction of the authorized body with organizations of mediators and other interested parties for the development and improvement of the mediation institute in Kazakhstan.

The tasks of the Coordinating Council are:

development of proposals for improving legislation in the field of mediation;
assistance in the formation and implementation of state policy in the field of mediation;
analysis of problematic issues arising in mediation practice and development of recommendations for their solution;
development of self-regulation in the field of mediation and strengthening the institution of professional responsibility of mediators;
ensuring an open dialogue between mediation organizations and the authorized body;
approval of training programs for training and professional development of mediators.
development and approval of the standard charter of mediation organizations.
The Coordinating Council performs the following functions:

discusses issues of professional training and professional development of mediators;
develops proposals and develops recommendations on creating favorable conditions for the development of the mediation institute and its further improvement;
considers proposals for the development of a system of self-regulation of mediation organizations;
organizes the exchange of experience and information between organizations of mediators;
considers and develops proposals for resolving problematic issues arising in the practice of mediation;
organizes and conducts dialogue platforms with the participation of mediation organizations, including those with international participation;
conducting approval of training programs submitted by mediation organizations.
The Coordinating Council consists of the Chairman, the Vice-Chairman, the Secretary and the members of the Coordinating Council.

The composition includes representatives of the authorized body, organizations of professional mediators included in the register of organizations of mediators under the authorized body.

The composition of representatives of mediation organizations is updated at least once a year.

The order is put into effect from the date of signing.

In March 2025, a regular meeting of the mediation working group was held in Astana, where proposed changes and additions to the Rules for Training Mediators and coaches of Mediators were discussed. The proposals of the IPC management included in these Rules in the draft regarding an increase in the number of training hours for mediators, the introduction of standards for the training course for mediator trainers, additional requirements for candidates for coaches, changes in the content of a special course for mediators, and advanced training for mediators. The project is still under development.
We have also made proposals to the draft Regulation on the establishment of the Coordinating Council (CC) for Mediation under the Ministry of Culture and Information of the Republic of Kazakhstan, they have also been adopted and taken into account. Currently, the Ministry is creating a Mediation Coordination Council, which will include all heads of mediation organizations and representatives of government agencies, as well as experts. Zhakupov Zhandilda spoke at the Ministry's meeting on China's initiative to establish an international mediation Organization. To date, there has not been and is not yet an international mediation organization in the world that unites mediators at the interstate level. Such an initiative is currently being undertaken by China. All countries, including Kazakhstan, are invited to sign this convention or participate in the signing ceremony. The signing of the concept is scheduled for May 30, 2025.
