Videoconference on the topic: “Mediation in modern conditions”

  16 June 2020 a videoconference was held on the topic: “Mediation in modern conditions”, which was organized by the Mediation Cabinet of the Almaty House of Friendship in cooperation with the RPA “International Human Rights Center”. The conference was attended by professional and non-professional mediators, judges, heads of the mediation cabinet of the regional Houses of Friendship. The speaker of the conference was Zhakupov Zhandilda - President of the RPO “MPC”, an international class mediator trainer. Participants actively discussed issues of conducting mediation in a remote format, amendments accepted in the Code of Civil Procedure, and a bill on mediation and alternative dispute resolution methods. In a pandemic conditions, MPC mediators conduct mediations online through the zoom platform, telephone, email, Whats app, etc. At the same time, they are guided by the norms of the Civil Code of the Republic of Kazakhstan, which allow concluding deals through the exchange of electronic messages, etc. The Civil Procedure Code of the Republic of Kazakhstan accepted new rules that increased the conciliation period to 10 working days at the stage of deciding to initiate a civil case, increased the number of disputes that could be resolved in a simplified manner without calling the parties, abolished the mandatory meeting room and much more. A bill aimed at developing alternative methods of prejudicial settlement has been developed by working group of the Senate of the Parliament of the Republic of Kazakhstan. The bill has passed legal review and is being finalized. It suggested compulsory mediation and conciliation procedures before the court in family, land and labor disputes, as well as an informational conversation in criminal and administrative cases.
